Firehouse International Rental Contract

Trained User Agreement.
Listed on the face of the Rental Agreement and other attached here to are the items of equipment you have requested to rent from Firehouse International. Because the jobs on which this equipment is used are often highly hazardous, Firehouse requires that any person using the equipment must have received complete instructions, both in classroom and hands on, on the proper use and limitations of each item of equipment. Your acceptance of the equipment for rent certifies that your employees have been properly trained in the use and limitations of the equipment, and you will assume liability for improper use of the equipment.

1. Firehouse International hereby agrees to rent equipment to customer named on the face of this Rental Agreement. The terms and conditions of this Agreement shall apply to all Equipment rented by Firehouse International to the customer now or in the future. Such equipment shall remain the sole and exclusive property of Firehouse. Customer shall have no right, title or interest therein except as expressly set forth here in.


2. Rental Period. The Equipment is rented on a daily, weekly basis. The rental period shall commence on the date Firehouse Ships the equipment to the customer and shall continue upon the terms of this Agreement until the date the Equipment is returned to Firehouse International.


3. Rent.
The rental billing invoices are processed in arrears on monthly basis. If parts are shipped with the rental . an invoice for the parts will be generated immediately for parts only.
4. Recalibration / Maintenance Fee's. In addition to rent, in some cases the Customer shall pay a one-time recalibration / maintenance fee.


5. Delivery and Return.
All Equipment is provided FOB shipping point. Unless Customer notifies Firehouse to the contrary with in 48 hours after receipt of the Equipment, it shall be conclusively presumed that the Equipment in accordance with all established requirements for Customer's Job Site. If Firehouse International determines that the Equipment is not thoroughly decontaminated, Firehouse may charge Customer additional service charges for the cost of decontamination or replacement.


6. Late Charge.
Customer shall pay to Firehouse International late charge, equal to $10 or two percent per month of the late payment which ever is greater. Upon any default, in addition to charging late charges, Firehouse shall have the right to terminate this Agreement, take immediate possession of the Equipment and recover from Customer all amounts due hereunder, together with Firehouse International costs and reasonable attorneys' fees.


7. Security Deposit. Firehouse International may require a security deposit, this deposit shall be returned to Customer after deducting any amounts due to Young's from the customer. Amounts deducted from the deposit may include cost of repairing a or replacing damaged or contaminated equipment, unpaid rent, rent for the balance of any unexpired rental period and unpaid service charges for cleaning, recalibration or denominating the equipment

8. Ownership; Use. The Equipment shall remain the property of Firehouse International and is provided to Customer solely on rental basis with out any option to purchase unless such option is granted prior to the commencement of the rental period.


9. Safekeeping. Customers is responsible for the safekeeping of alt Equipment and shall bear the risk of any loss, theft.
damage or destruction of the Firehouse equipment. Customer shall pay the current list price of any item which is lost, stolen, destroyed or damaged or contaminated beyond repair.


10. Acceptance. Limitation or Liability, Disclaimer. Assignment of Warrant~. Customer represents and agrees that the Equipment is of a size, design, capacity and manufacture selected by Customer and Customer has unconditionally accepted each item of Equipment.

  • Firehouse International shall not be liable to customer for any liability, loss or damage caused or alleged to be caused directly or indirectly by the equipment, by any inadequacy thereof or deficiency or defect therein, by an incident whatsoever in connection therewith unless such damage or loss is directly caused by
    Firehouse International intentional acts.
  • Firehouse International neither makes nor shall be deemed to have made, and customer hereby expressly waives, any warranty or representation. Either express or implied, as to the equipment. Including with out limitation. Any warranty or representation.
  • Customer confirms that it has selected the equipment and each part there or on the basis of its own judgment and expressly disclaims reliance upon any statement, representation or warranties made by
    Firehouse and customer acknowledges that
    Firehouse International is not a Manufacture, vendor or consultant or any part of the equipment


11. Indemnification of Firehouse International. Customer shall indemnify, hold harmless and defend Young's from any and all claims, actions and damages, including attorneys' fees, arising out of the equipment and its use, rental, possession, operation,

condition, purchase, and return, including without limitation any such claims arising out of the theory of strict liability in tort, which obligation shall survive termination of this Agreement.
